Mengarah.com – Asuransi atau pertanggungan terjadi karena kebutuhan manusia. Manusia pastinya selalu dihadapkan kepada  suatu hal yang tidak pasti, bisa saja menguntungkan bisa juga tidak menguntungkan. Sehingga Resiko atau bahaya yang dapat menimbulkan kerugian pada manusia dapat membuat manusia takut dan merasa khawatir, hal inilah yang mendorong manusia untuk memikirkan segala cara supaya terhindar dari resiko atau bahaya tersebut. Cara yang dilakukan oleh manusia salah satunya adalah dengan cara mengalihkan resiko atau bahaya kepada pihak lain yang bersedia menerima peralihan risiko tersebut yaitu perusahaan asuransi.

Dalam ketentuan Pasal 1 ayat (1) Undang-Undang Nomor 2 Tahun 1992 yang dimana ketentuan ini telah diperbaharui menjadi Undang-Undang Nomor 40 Tahun 2014 dan tetap mengatur tentang Usaha Perasuransian menyatakan bahwa, Asuransi atau pertanggungan merupakan perjanjian antara dua belah pihak atau lebih, yang mana pihak penanggung mengikat diri kepada tertanggung dengan menerima premi asuransi, atau kehilangan keuntungan yang mungkin saja akan diderita tertanggung, yang timbulkan dari suatu keadaan yang tidak pasti, atau untuk memberikan suatu pembayaran yang didasarkan atas meninggal atau hidupnya seseorang yang dipertanggungkan.

Dalam hal ini perusahaan asuransi sebagai pihak penanggung yang bersedia mengambil alih resiko dari pihak tertanggung, harus memiliki hubungan hukum yang mengikat kedua belah pihak tersebut . Hubungan hukum tersebut terjadi karena adanya kesepakatan antara kedua belah pihak  yang dituangkan dalam suatu perjanjian tertulis berbentuk akta yang disebut polis. Polis tersebut tidak hanya berisi tentang kesepakatan para pihak mengenai peralihan resiko, tetapi juga berisi tentang hak dan kewajiban para pihak yang harus dipenuhi. Oleh karena itu polis ini berfungsi sebagai alat bukti apabila suatu saat terjadi klaim atau terjadi sengketa antara para pihak.

Perusahaan asuransi merupakan salah satu badan hukum yang turut serta dalam kegiatan ekonomi belum tentu selalu memiliki kondisi ataupun keadaan perekonomian yang baik, dan selalu dapat memenuhi segala kewajibannya kepada pihak lain. Kondisi perekonomian yang tidak baik tersebut dapat membuat perusahaan asuransi tidak mampu melunasi utang atau tidak mampu memenuhi segala kewajibannya, oleh karena itu hal ini dapat membuat keadaan menjadi pailit. Kepailitan yang dimaksud disini adalah suatu usaha yang harus dilakukan untuk membantu mencari jalan keluar atau mencari cara untuk menyelesaikan permasalahan yang dialami dimana debitor tidak dapat atau tidak mampu melunasi utang-utangnya, meskipun begitu hak para pemegang polis atau nasabah asuransi tetap akan dilindungi oleh hukum yang diatur dalam Undang-Undang No. 37 Tahun 2004 tentang Kepailitan.
